(hereinafter “Provider” or “we”)
1. Scope
The services offered by the provider at www.supana.org are provided exclusively in accordance with the following Terms and Conditions, as amended at the time of booking.
Our General Terms and Conditions apply exclusively. Any terms and conditions of the purchaser that deviate from our General Terms and Conditions are invalid unless we expressly agree to them.
2. Customer Account
To purchase time credits, manage them, and use them to reserve SUP boards, you must first register as a user.
You must provide the contact information and other details requested by the provider during the registration process completely and accurately.
Once you have provided all the requested information, the provider will verify that it is complete and accurate. If the provider determines that the information is correct and there are no other concerns, the provider will activate your requested access and notify you via email.
During the registration process, you will be asked to provide a username and password. Once your account has been activated, you can use these credentials to log in to our website. You must keep your login credentials, including your password, confidential and must not disclose them to third parties. If there is reason to believe that unauthorized third parties have obtained or may obtain your login credentials, you must notify the provider immediately.
You are liable for any use and/or other activity carried out using your login credentials, in accordance with applicable law.
You are required to keep your information (including your contact information) up to date. If any of the information you provided changes during the term of your participation, you must immediately update it in your personal settings within your online customer account. If you are unable to do so, please notify us of your updated information immediately via email.
3. Conclusion of the Contract
The services available for booking on our website constitute a non-binding invitation to the customer to purchase time credits or to use these time credits to rent stand-up paddleboards (“SUP boards”) and accessories for a selected period. By submitting the order (clicking the “Book Now” button) on our website, the customer makes a binding offer to enter into a contract. The contract for the purchase of time credits is concluded with the provider. The contract for the rental of a SUP board for the period selected at the time of booking is concluded with the location operator selected at the time of booking.
Confirmation of receipt of the time credit booking is sent immediately after the order is submitted and does not, in principle, constitute acceptance of the contract. We may declare acceptance within five days by sending an order confirmation in writing (via fax or email), in which case the receipt of the order confirmation by you is decisive, or by requesting payment from you after the order has been placed (e.g., for PayPal payments). If several of the aforementioned alternatives apply, the contract is concluded at the time the first of these alternatives occurs. If we do not declare acceptance within the aforementioned period, this shall be deemed a rejection, with the result that you are no longer bound by your declaration of intent.
Confirmation of receipt of the reservation for SUP board rental periods, as well as acceptance of the contract, will be provided immediately after the reservation request is submitted by sending the login information for the Supana Box.
When a customer submits an order via the provider’s online order form, the provider saves the contract text and sends it to the customer in text form via email, along with these Terms and Conditions, after the customer submits their order. In addition, the contract text is archived on the provider’s website and can be accessed free of charge by the customer via their password-protected customer account by entering the appropriate login credentials, provided the customer has created a customer account in the provider’s online store prior to submitting their order.
Before submitting a binding order via the provider’s online order form, the customer can correct their entries at any time using standard keyboard and mouse functions. In addition, all entries are displayed once more in a confirmation window before the order is submitted, and can also be corrected there using standard keyboard and mouse functions.
The contract may be concluded exclusively in German or English.
4. Subject Matter of the Agreement
(1) The customer purchases a time credit from the provider, which allows the customer to rent SUP boards via the provider’s website for the duration booked by the customer, to be picked up and returned in person at the SUP stations of the location operator selected during the booking process. The rental item is provided exclusively for contractual use within the vicinity of the SUP station; that is, unless otherwise agreed, the SUP board may only be used within a one-kilometer radius of the SUP station.
(2) The customer is obligated to return the SUP board and accessories in the same condition in which they were received. This does not include normal signs of wear and tear (e.g., scratches, discoloration). Please inspect the SUP board carefully when you remove it from the compartment and notify us if you notice any damage to the SUP board that goes beyond normal wear and tear (e.g., scratches, discoloration).
5. Right of Withdrawal
Consumers generally have the right to cancel distance contracts.
However, the right of withdrawal does not apply to contracts for the provision of services related to leisure activities if the contract specifies a specific date or time period for the provision of such services.
Pursuant to Section 312g(2)(9) of the German Civil Code (BGB), there is therefore no right of withdrawal for the booking and rental of SUP boards.
Consumers have a right of withdrawal regarding the purchase of prepaid time credits, as described below:

You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the date the contract is concluded.
To exercise your right of withdrawal, you must inform us (Supana Rent & Go GmbH, Holstweg 17, 14163 Berlin, info@supana.org) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by mail, fax, or email). You may use the attached model withdrawal form for this purpose, although this is not mandatory.
To meet the deadline for cancellation, it is sufficient for you to send notification of your intention to cancel before the cancellation period expires.
Consequences of the revocation
If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without delay and no later than fourteen days from the day on which we receive notification of your cancellation of this contract. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund.
If you have requested that the services begin during the cancellation period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you notify us of your exercise of the right of cancellation with respect to this contract, compared to the total scope of the services provided for in the contract

6. Lease Term and Handover
The provider will make the SUP board available for pickup at the selected/booked location and will provide the customer with the access information for the SUP station’s storage locker. The provider is not obligated to provide any additional services beyond this.
The rental period begins when you remove the SUP board from the locker and ends when you have returned the SUP board and all accessories to the locker and closed the door.
The SUP board and accessories must be picked up and returned at the times selected by the customer at the time of booking. At the end of the rental period, the customer must return the SUP board in good condition to the locker assigned to them in the booking confirmation.
If the rental period is exceeded or not fully utilized, time credits will be deducted or added in one-minute increments.
7. Payment
The prices listed on our website at the time of booking apply. All prices include the applicable sales tax.
The customer purchases a time credit on our website to pay the rental fee. Payment for the selected time credit is made in advance and can be made via PayPal or credit card. If the “PayPal” payment method is selected, payment processing is handled by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, subject to the PayPal Terms of Service, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full.
The purchased time credit remains valid for 12 months. The specific rental period booked for the SUP board is deducted from the time credit. If the customer does not use up the time credit within these 12 months, they can initiate a refund to the same payment method at any time via their customer account.
8. The Customer’s Duty of Care
During the rental period, the customer is responsible for the SUP board and its accessories and is required to
to follow the usage and safety instructions provided by the provider and the site operator when using the facility,
to exercise reasonable care and use proper judgment when using the SUP board,
to use the SUP board only in accordance with local safety regulations,
Do not remove, alter, or obscure any markings on the rented property, particularly signs, numbers, or labels,
Do not leave your SUP board unattended when you are not using it
to stop using the SUP board as soon as possible if weather or water conditions require it, or if you notice a defect in the SUP board, and to notify us of this defect immediately
to notify us immediately if he is involved in an accident or incident involving the SUP board, even if no third party was involved.
9. Right of Withdrawal
The customer can cancel their reservation at any time by returning the SUP board and accessories to the locker and canceling the credit for that specific reservation via the reservation screen (My Reservations). Any time that has already elapsed since pickup will be deducted, and the unused time will be credited back to the customer’s time balance.
10. Customer Rights in the Event of Defects
(1) The customer receives the rental property in a condition suitable for its intended use and is responsible for carrying out the necessary maintenance and repair work. The necessary maintenance and repair work is performed at regular intervals and whenever defects or damage occur.
(2) The customer must immediately notify the provider of any defects, malfunctions, or damage that occur.
(3) If defects are found, the customer may, after notifying the provider of the defect, select a different SUP board from another rack. If no other SUP board is available, the customer will be credited with the time credit for the booked session by exercising the right of withdrawal described in Section 9.
11. Limitations of Liability
(1) The provider is liable without limitation for damages in accordance with applicable law
(a) arising from injury to life, limb, or health resulting from an intentional or negligent breach of duty or from any other intentional or negligent conduct on the part of the Provider or one of its legal representatives or agents;
(b) due to the absence or loss of a warranted characteristic;
(c) that result from a breach of duty committed with intent or through gross negligence, or from any other intentional or grossly negligent conduct on the part of the provider or one of its legal representatives or agents.
(2) The Provider shall be liable, limited to compensation for foreseeable damages typical for this type of contract, for damages resulting from a breach of material contractual obligations (i.e., obligations whose fulfillment is essential for the proper performance of the contract and on whose fulfillment the Customer may reasonably rely) committed through slight negligence by the Provider or one of its legal representatives or agents.
(3) The foregoing provisions shall apply mutatis mutandis to the Provider’s liability for reimbursement of futile expenses.
(4) Liability under the Product Liability Act remains unaffected.
12. Other Agreements
(1) Any amendments or additions to these Terms and Conditions must always be made in writing to be effective.
(2) If any provision of these Terms and Conditions is or becomes invalid in whole or in part, or if these Terms and Conditions contain a gap, the validity of the remaining provisions shall remain unaffected.
(3) The contracts concluded between the provider and the customers are governed by the substantive law of the Federal Republic of Germany.
13. Information on Online Dispute Resolution / Consumer Mediation
The European Commission provides an online dispute resolution platform at the following link: https://ec.europa.eu/consumers/odr
This platform serves as a point of contact for the out-of-court resolution of disputes arising from online sales or service contracts involving a consumer. The provider is neither willing nor obligated to participate in consumer dispute resolution proceedings under the VSBG.
